~ GENERAL INFORMATION
By purchasing a registered cat you agree to comply with the terms and conditions of those registries as well as these terms listed below:
I/We, _________________________________,(hereinafter referred to as 'purchasers' and 'buyers') engage in this contract with Kerry Knight (hereinafter referred to as 'we'/ 'sellers'/ 'breeders' and 'us') for the purchase of __ Kitten / Cat __ Male / Female born on ___________________.
The price of said kitten is _$________ with breeding/ showing/ pet only registration. There is a $200 non-refundable deposit for the desired purchase of any cat or kitten not paid for in full at time of contract signing. Without this deposit, we will not hold any kitten for any amount of time.
No kitten will leave the sellers home before they are at least twelve weeks of age. The kitten will leave here after a health check from our vet and his/ her vaccinations age appropriate.
~ REGISTRATION/BREEDING RESTRICTIONS
Registration papers will be mailed to the purchaser as this is safer than putting them in the carrier when shipped, paperwork has a tendency to go missing from the carrier on flights. Kittens that are picked up in person, will have all relevant papers handed to buyer.
Pet only kittens are to be sold under a strict spay/neuter contract ONLY! (this means to receive the registration papers on the cat, purchaser must present veterinarian proof of the cat being spayed/neutered within four months of the purchase date). We always attempt to spay/neuter before the pet leaves for their new home, but this is not a guaranteed service. If said cat/kitten is not spayed/neutered by the date of ________________ the portion of this contract for any registration is null and void and no papers for the cat/kitten will be given to the purchaser and animal may be repossessed by the sellers.
No kittens bought from us will be sold to a pet store, broker, kitten mill, fur farm, experimental lab, or any other facility that is not a personal home; if this is found, legal action will occur. Buyer will give US first offer to take this kitten back, we will always take a kitten back no matter how old.
~ Health
We love our cats and only sell happy, healthy, good-tempered kittens.
All kittens will be up to date with their vaccinations when they leave us, buyer will continue with their vaccinations as they are needed.
Purchaser must provide cat/kitten with an environment that is protected by the elements at all times, Sphynx cats can suffer from sunburn.. Cat/kitten will NOT be permitted to go outside at any time! These kittens will most likely be stolen if allowed to roam.
Seller promises animal to be free of any genetic flaws at time of sale (unless otherwise disclosed to buyer prior to signing contract). All animals leave sellers care in perfect health to the best of our knowledge. A one year health guarantee is offered provided buyer takes animal to a licensed veterinarian within 48 hours (2 business days) of receiving the animal at their own expense, if animal has any genetic diseases or genetic abnormalities/ defects not disclosed to buyer in advance, buyer may return the animal for replacement of an equal value animal upon availability, minus all shipping costs (if any), no cash refunds are given.
Any problems or replacement requests pertaining to the health guarantee must be submitted via postal mail with veterinarian proof that problem is genetic, proof of vet attendance within 48 hours of receiving animal, and a brief letter explaining the situation. If buyer fails to take animal to a veterinarian within two business days, the health guarantee is voided due to buyer's negligence. Defects appearing two or more years after the purchase are not covered. Buyer is completely responsible for any and all veterinarian expenses occurred.
{The above is only applicable if the genetic problem affects the health or ability for the animal to live a normal life. Genetic abnormalities will NOT include flaws in the breed standard, such as weight, height, ear, nose, tail, and all other physical features. Seller is only liable for genetic problems, not responsible if animal gets sick via virus, bug, or any other communicable or non-genetic disease.}
Kittens should grow into proper size as in the breed standard; however we cannot guarantee their final size as Mother Nature is impossible to predict.
~ Payment
Full payment of all cats/kittens is required within two months (eight weeks) after the contract / deposit is dated. We will accept weekly payments as well as keep logs and will give receipts. We will not track you down for payments and if payment is not received fully and/or no further contact is made by purchaser to seller after the agreed time period, the contract will be voided and the cat/kitten will be put back up for adoption.
Buyer will receive a copy of the contract from seller, the buyer is welcomed to scan/photo copy the contract before submitting it to seller.
If shipping is needed...
A shipping fee of ___$250____ is required for the cat / kitten being shipped. The shipping fee will include the price of a carrier, health certificate, and air fare. After payment is fully received, a specific date will be arranged for the animal to be shipped via aircraft. We reserve all animals on a first deposit first serve basis, if no deposit is made/ received by an agreed date we will not hold the animal. If weather becomes an issue with shipping an animal, neither the buyer nor seller will be responsible unless fault is proven and the animal will be sent as soon as possible.
By signing this contract you agree to all of its terms and conditions, the contract may not be renegotiated after signing and is fully binding. You are free to take the contract home and look it over before signing. If a deposit is made before a contract signing and purchaser later wants to negotiate the contract, we will talk but do not promise to change any part of the contract and if you find something unacceptable and wish not to continue with the sale your deposit is still non-refundable. If deposit/ payment is paid via Paypal, or some other online payment system, before receiving a contract in the mail, this contract will have been e-mailed to purchaser and it is understood that the purchaser accepts the terms and conditions of this contract before signing. Animals will not be sent without a signed contract and complete payment.
Make sure the bottom of every page is initialed before returning or contract may not be accepted, failure to initial a page does not void or remove the page from the contract and it is still understood that you read and agree to the terms of that page.
TYPOGRAPHICAL ERRORS ARE NOT GROUNDS TO VOID CONTRACT.
